These Terms of Use govern your use of noahsarkfinancial.com(the “Site”) and any related communications, scheduling, or resources accessed through it. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Who operates this Site

The Site is operated by Peter Guggisberg, a Financial Services Representative of Massachusetts Mutual Life Insurance Company (“MassMutual”) through the Vermont Financial Group of New York. Noah’s Ark Financial is the personal brand under which Peter publishes content + meets with families. Noah’s Ark Financial is not a separate licensed insurance agency, broker-dealer, or registered investment adviser.

Insurance products are offered through MassMutual and other carriers licensed in the states where Peter is appointed. Securities, investment advisory, and financial planning services, where applicable, are offered through MassMutual or its affiliated entities and are subject to those entities’ supervision and disclosures.

No insurance contract, no investment advice

The content on the Site is for general educational and informational purposes only. Nothing on the Site:

• Constitutes an insurance contract or binder.
• Guarantees the availability of any insurance product at any rate.
• Constitutes individualized investment, tax, legal, or accounting advice.

The Advisor does not control, endorse, or assume responsibility for third-party content, accuracy, or practices. Brand storyworld disclosure

Noah’s Ark Financial includes a brand storyworld featuring illustrated characters (Noah, the Buckley deer family, the Sorrell fox family, the Harlow bear family, and others). These characters are AI-generated brand elements. They do not represent real clients, real plans, or real outcomes. Any resemblance to a living person is coincidental. The financial planning work the Advisor does is real; the characters illustrating it are not.

Intellectual property

Site content, including text, illustrations, photos, and the Noah’s Ark Financial brand marks, is owned by Peter Guggisberg or used under license. You receive a limited, non-exclusive, revocable license to view + read the content for personal, non-commercial use. Republication, scraping for AI training data, or use of the content in derivative commercial materials requires advance written permission.

Privacy

Use of the Site is also governed by the Privacy Policy, which describes how information you submit is collected, used, and shared.

Disclaimer + limitation of liability

The Site is provided “as is” and “as available” without warranty of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Peter Guggisberg shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or business opportunities, arising from your use of the Site or reliance on its content. Total liability for any claim arising from your use of the Site shall not exceed one hundred dollars ($100), or the amount you actually paid to use the Site (typically zero), whichever is greater.

Nothing in this section limits any rights you have as a client under an executed engagement, under applicable insurance regulations, or under MassMutual’s own client agreements.

Indemnification

You agree to indemnify and hold harmless Peter Guggisberg, MassMutual, and the Vermont Financial Group of New York from any claim, loss, or expense (including reasonable attorney’s fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right in connection with your use of the Site.

Regulatory + compliance

Insurance and financial services on the Site are subject to:

• New York Insurance Law and the regulations of the New York State Department of Financial Services.
• MassMutual’s internal compliance policies, including advertising review.
• Where applicable, FINRA + SEC rules governing the conduct of associated persons of a broker-dealer or investment adviser.
• Federal privacy and consumer-protection laws.

Where any provision of these Terms conflicts with a binding regulatory requirement, the regulatory requirement controls.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in New York, unless a binding regulatory requirement designates a different forum.

Updates to these Terms

These Terms may be updated from time to time. When they change, the “Last updated” date at the top of this page changes. Continued use of the Site after an update constitutes acceptance of the revised Terms.
